What Personal Data We Process and For What Purposes

We process your data depending on your interaction with us. Read more below:

When You Are a Client

We process personal data in order to fulfill an agreement regarding photography and/or video services. We also collect necessary data for invoicing purposes in compliance with accounting laws.

We collect the following information:

  • Name

  • Phone number

  • Email address

  • Geographical location

  • Your preferences for the photography/video session

If you provide sensitive information, such as health-related data, we will always request your explicit consent before processing it.

We do not share your data outside our company.

Data collected for accounting purposes is stored for 5 years after the end of the fiscal year, in accordance with the Danish Bookkeeping Act § 10, after which it will be deleted. Emails related to the customer relationship are typically stored for up to 6 months.

We do not use automated decision-making or profiling.

When You Visit Our Website

We process data to collect usage statistics and for targeted marketing. Data collection occurs through cookies – see more about cookies and how to opt-out in the section below.

Processing is based on our legitimate interest under the GDPR (balancing test), as we assess that collecting behavioral data does not infringe your fundamental rights.

Data collected includes:

  • IP address

  • Behavioral data on our website (e.g., visited pages, clicks)

We share direct and indirect personal data with third parties such as Vimeo, Google, and Facebook. Data transfers are only made if appropriate safeguards are in place, such as EU Standard Contractual Clauses (SCC) or other lawful transfer mechanisms under GDPR.

Analytics data collected by Google Analytics is stored for 26 months before being automatically deleted. Data shared with third parties is managed according to their own retention policies, over which we have no control.

We do not use automated decision-making. However, Google and Facebook are expected to use data for their own profiling purposes.

Our website may contain links to other websites or partners. We are not responsible for the content or privacy practices of those websites.

When Your Photos and/or Videos Are Published on Our Website or Social Media

We will never share your photos/videos without your explicit consent. Sharing only takes place after you have been informed about the procedures and consequences.

This cautious approach ensures that your personal data is protected. Consent can always be withdrawn. If photos include minors under 16 years old, we require consent from a parent or guardian.

Data processing is intended for the marketing of our company.

Photos and videos may be published on our website, Facebook page, or Instagram account. They then become publicly available.

We retain photos and videos for as long as we have a legitimate purpose and until consent is withdrawn.

If you withdraw consent by writing to info@nikolamajkic.com, your images and videos will be promptly removed from all our digital platforms. Printed materials cannot be altered, and therefore consent for printed materials cannot be withdrawn retroactively.

When You Visit Our Instagram Page

We and Meta (Instagram) collect and process personal data when you visit www.instagram.com/nikolamajkiccreates.

The purpose of this processing is to market our services and respond to inquiries.

Processing is based on our legitimate interest under GDPR.

Typically, data collected includes your account name. Sensitive information will be deleted immediately upon discovery.

Please note that data you provide on our Instagram page is processed both by us and by Meta (Facebook/Instagram).

We follow the Danish Data Protection Authority’s current guidelines regarding joint controllership and inform visitors accordingly.

As Instagram operates independently, we await their final data processing agreements concerning shared responsibility.

Information you post publicly remains visible as long as the page exists unless you request deletion.

We assume that Meta uses automated decisions and profiling. We ourselves do not use automated decision-making or profiling.

If you do not agree to data collection practices, we recommend avoiding visiting our Instagram page. Please refer to Instagram’s own privacy policies for further details.

Who We Transfer or Disclose Personal Data To

We use a number of suppliers (data processors) for hosting and operating our website and services.

We have signed data processing agreements with all suppliers to ensure your data is protected and not used for any other purpose.

We primarily use data processors located within the EU/EEA.

In some cases, we use processors in the USA but only if they meet the requirements set by GDPR (e.g., Standard Contractual Clauses).

We also transfer data to public authorities, such as SKAT (the Danish Tax Agency) and insurance companies, when legally required.

  • Right of Access: You may request access to the personal data we hold about you, including the purpose and legal basis.

How to Delete or Disable Cookies

You can always reject cookies by changing your browser settings.

Where to find settings depends on your browser. Please note that disabling cookies may cause some website functions to stop working.

Most browsers allow you to delete cookies individually or all at once.

If you use multiple devices or browsers, you must delete cookies on each one.

Most browsers offer a Do Not Track feature.

If enabled, third-party cookies like those from Vimeo will be automatically disabled, which might affect video playback.
